Prohibiting talent tests in Un-Aided Private schools - Instructions Issued - Rc.118

Sub: School Education - Un-Aided Private Educational Institution - Prohibiting talent tests - Instructions Issued - Regarding.

The District Educational Officers and Regional Joint Directors of School
Education are aware that the permission for establishment of schools under
private managements and their regulations are governed as per the rules issued in the G.Os !st and 2nd read above.
They are further informed that in accordance with the Right of Children to Free and Compulsory Education Act, 2009 the screening procedures/tests in terms of interviews/tests conducted for admission to any class from Pre-primary in any school under any management or any Syllabus (State syllabus/CBSE/ICSE/any other) shall be dispensed with. Any deviations in this regard are punishable under the Section 13(2)(b)of the RTEAct with fine, which may extend to Rs.25,000/• for the first contravention and Rs.50,000/- for each subsequent contravening admission.
Besides, the Hon'ble High Court while dismissing the Writ Petition No.114/2011, filed by a private management for conducting talent test, advised the Department to initiate action prohibiting the school managements from conducting talent tests under any name.
In view of the above circumstances all the RJDSEs and the DEOs in the State are hereby instructed that the private school managements does not conduct talent test of any kind - admission test/ screening test/ talent test and scholarship test or any test for getting admission in the schools.

Whenever, such incidence comes to the notice of the RJD/DEO/ Dy.EO/MEO, immediately necessary action should be initiated against such erring managements as per AP Education Act. Such schools should be derecognized duly following the procedure.
They are also instructed to give wide publicity using print, electronic, district website(s),and Social media to enlighten the parents.
Further, The RJDSE/DEOs are requested to issue a press note to reach out to as many people as possible on both the issues enlightening public to bring the occurrences of such instances to their notice. Soon after receipt of information take immediate action to stop such instances and take appropriate action against such schools/managements as per RTE Act and APEducation Rules.
These instructions issued shall be scrupulously followed without any deviation and ensure prevented from conducting talent tests in their respective districts.
